Board Meeting

April 21, 2018

 Board Members Present: Meeting called to order at 8:03 am by President Terry Denner. Board members present: Tom Reimer,  Bruce Copeland, Jane Ertl, Chad Williams, Tony Reyerson  Absent: Bob Buhrow Also present were Helen Schwietert (Treasurer) Laurie Helling (Secretary)

Members Present:   Doug Hintzman, Chris Miller, Cindy Miller, Wayne Jensen, Steve Sheppard, Don Niosi, Kari Winders, Earl Burkle

Minutes:

  • Motion made to approve the board minutes of 10-21-17 by Tony Reyerson  2nd by Chad Williams.  All approved. Motion carried.

Treasurer’s Report:

  • Treasurer’s Report & statement presented by Terry Denner.
  • Motion made by Tony Reyerson to approve Treasurer’s report. 2nd by Chad Williams.  All approved. Motion carried.

 Bills:

  • Bills Presented:  Utilities, snow removal & sanding, taxes, Bi-County
  • Tony Reyerson made motion to approve bills, 2nd by Chad Williams. Motion carried.

Building Permits:

  • **Update: Max Smith completed requested changes
  • Sheppard : Submitted permit for garage/building, all proper permits in order
  • Allyn: Paved drive to road
  • Harbaugh: Waiting on DNR permit

Property Ownership Changes:

  • Lot 75 & 76, 338 & 340 River Road from Gifford to Ken Root/Jane Ertl

Road Report:  

  • Nothing to report at this time.

 Boat Storage Committee:  Don Niosi reports there is only 1 new opening at this time for boat storage.

 Ramp Committee:   The new boat ramp approach will be poured within next two weeks, weather permitting.

  • It was brought to attention of board to possibly block off 2nd Ave ramp next winter with a rope or chain. A visitor to the island accidentally drove down and got stuck this winter.

Beautification Committee:  Nothing new to report at this time

Pond Committee:  **See under New Business

OLD BUSINESS:

North Ramp-.

  • The new boat ramp approach will be poured within next two weeks, weather permitting.
  • Pond fund is now just under $1000
  • Tony Reyerson suggested Assoc. pay for a survey of back lot lines by pond/common ground
  • Discussion on placing large rocks or landscaping to prevent cars/trucks from driving through common grounds to by pond to back properties. Accessible by carts only.
  • We now have donated swings, basketball pole

 NEW BUSINESS:

  • Neal property last year payment and pro-rated until end of May is paid.
  • Insurance payments have now all been moved to August
  • FYI: Alliant Energy will be redoing some of the overhead lines, burying new lines and added a new transformer to boost the power for back road area of island. No expense to association.
  • A proposal was raised to contact Black Hills to remove the gas meter on Island building and look at alternative for the furnace. Approx. $400 yr for the meter that rarely is used.
  • It was brought to board’s attention of dogs running loose on the island this winter and early spring.
    • Dog waste was not being picked up
    • Island members were startled and scared as unleashed dogs have suddenly run out while they’ve been walking or just appearing in their yards.
    • Discussion held on leash policy which is already in existence, and also an additional policy should be posted on “Owner Responsibilty” and owner’s own liability.
  • Terry Denner made motion to post the following as a guideline to abide for island dog owners, and guests of Island members abide by leashing pets, control of pets on your property. Clean up after them.
  • All Approved, motion carried.

Current State Laws:

351.25. Dog as property

All dogs under six months of age, and all dogs over said age and wearing a collar with a valid rabies vaccination tag attached to the collar, shall be deemed property. Dogs not provided with a rabies vaccination tag shall not be deemed property.

351.26. Right and duty to kill untagged dog

It shall be lawful for any person, and the duty of all peace officers within their respective jurisdictions unless such jurisdiction shall have otherwise provided for the seizure and impoundment of dogs, to kill any dog for which a rabies vaccination tag is required, when the dog is not wearing a collar with rabies vaccination tag attached.

351.27. Right to kill tagged dog

It shall be lawful for any person to kill a dog, wearing a collar with a rabies vaccination tag attached, when the dog is caught in the act of chasing, maiming, or killing any domestic animal or fowl, or when such dog is attacking or attempting to bite a person.

351.28. Liability for damages

The owner of a dog shall be liable to an injured party for all damages done by the dog, when the dog is caught in the action of worrying, maiming, or killing a domestic animal, or the dog is attacking or attempting to bite a person, except when the party damaged is doing an unlawful act, directly contributing to the injury. This section does not apply to damage done by a dog affected with hydrophobia unless the owner of the dog had reasonable grounds to know that the dog was afflicted with hydrophobia and by reasonable effort might have prevented the injury.

351.33. Rabies vaccination

Every owner of a dog shall obtain a rabies vaccination for such animal. It shall be unlawful for any person to own or have a dog in the person’s possession, six months of age or over, which has not been vaccinated against rabies. Dogs kept in kennels and not allowed to run at large shall not be subject to these vaccination requirements.

351.36. Enforcement

Local health and law enforcement officials shall enforce the provisions of sections 351.33 to 351.43 relating to vaccination and impoundment of dogs. Such public officials shall not be responsible for any accident or disease of a dog resulting from the enforcement of the provisions of said sections.

351.37. Dogs running at large–impoundment—disposition

A dog shall be apprehended and impounded by a local board of health or law enforcement official if the dog is running at large and the dog is not wearing a valid rabies vaccination tag or a rabies vaccination certificate is not presented to the local board of health or law enforcement official.
